The Terms of reference of the Council shall be as under :-

  • The Council shall function as per the provisions of the Biological Diversity Act, 2002 (Central Act 18 of 2003) and the Biological Diversity Rules, 2004.
  • The Council shall constitute a fund, after concurrence of the Finance Department which shall be known as "Jammu and Kashmir Biodiversity Council Fund" and all the fees , charges and benefit sharing amount received by the Council shall be credited to it. The amount so received in the Fund shall be used only for the purposes mentioned in Section 27(2) of the Biological Diversity Act, 2002.
  • The Jammu and Kashmir Biodiversity Council Fund shall be utilised only for the purpose provided for in terms of Section 27(2) of Biological Diversity Act, 2002
  • The Council shall shall perform such functions within the jurisdiction of the Union Territory of Jammu and Kashmir, as have been vested to the State Biodiversity Board, under various provisions of the Biological Diversity Act, 2002.
  • The Council shall in consultation with the National Biodiversity Authority, notify the format and procedures for seeking approvals as required under Section 7 of the Act.

Prior to reorganization in erstwhile state of Jammu and Kashmir, J&K State Biodiversity Board had been constituted vide SRO-57 dated 19-02-2013 under Section -22 (1) of Biodiversity Act, 2002 with its headquarters at J&K State Forest Research Institute.
